Whispering Wings Wellbeing™ is owned and operated by Biofield Transformations, LLC. “Whispering Wings Wellbeing™” and related marks, logos, and names are trademarks of Biofield Transformations, LLC. Other names and logos may be trademarks of their respective owners.

Welcome to Whispering Wings Wellbeing (https://whisperingwingswellbeing.com). By accessing our website, app, or services, you agree to be bound by the following Terms of Use. Please read them carefully. If you do not agree to these terms, you must not use our services.

1. Acceptance of Terms

By using our site, app, or services, you confirm that you accept these Terms of Use and agree to comply with them. If you do not agree, please refrain from using our offerings.

You must be at least 13 years old to use Whispering Wings Wellbeing. If you are under 18, you represent that you have parental or guardian consent.

2. Changes to These Terms

We may revise these Terms of Use at any time. Updates will be posted on this page with a new “Effective Date.” Your continued use after changes means you accept the revised terms.

3. Access and Availability

We strive to make our services available, but we do not guarantee continuous access. We may modify or discontinue any service without notice. You are responsible for ensuring that all persons accessing our services through your connection comply with these Terms.

We may impose limits on certain features or restrict access without notice.

Access to certain content and features requires an active subscription or membership. We may change, suspend, or remove free content at any time.

4. User Accounts and Passwords

You may be required to create an account. You are responsible for maintaining the confidentiality of your login information. We reserve the right to disable accounts if we believe these Terms have been violated.

5. License to Use Content

All content in the services (including meditations, sound recordings, videos, images, text, and software) is owned by Biofield Transformations, LLC or its licensors and is protected by intellectual-property laws. Subject to your compliance with these Terms and an active membership (where applicable), we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the content for your personal, non-commercial, non-medical purposes.

You may not copy, reproduce, record, download, distribute, publicly perform, create derivative works from, sell, resell, or exploit any content, except as expressly permitted in writing by us.

This license terminates automatically if your subscription ends or these Terms are terminated, but sections relating to intellectual property ownership and restrictions survive termination.

6. Subscriptions, Free Trials, Billing & Cancellation

Access. Access to certain content or features may require an active subscription purchased outside of the app through our website or other authorized platforms.

Auto-renewal. Paid subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before renewal.

Manage/Cancel. Subscriptions purchased outside of the app may be managed through your account on our website or through the platform where the purchase was made.

Trials. If offered, free trials convert to a paid subscription at the end of the trial unless you cancel before it ends.

Pricing & taxes. Prices may change with notice where required by law. Applicable taxes may be added.

Refunds. Subscription purchases made outside of the app are subject to our refund policies. For questions, contact [email protected]

7. Training & Student Code of Conduct

By enrolling in any training program, course, or certification offered through Whispering Wings Wellbeing™, you agree to abide by the following expectations:

• Respectful Participation: Treat instructors and fellow students with kindness and respect. Disruptive, harassing, or abusive behavior is not tolerated.
• Confidentiality: Respect the privacy of others by not sharing their personal information or experiences outside the training environment.
• Copyright & Intellectual Property: Do not copy, share, or distribute course materials, videos, or attunements outside of the platform without written permission.
• Appropriate Use: Use community forums, chats, and discussion spaces in a constructive and respectful manner.
• Grounds for Removal: We reserve the right to suspend or remove students from training programs or community spaces for violations of these rules, without refund, if behavior is harmful to the learning environment.
• No Guarantee of Professional Outcomes: Training and certification are educational in nature and do not guarantee employment, client acquisition, or legal recognition. You are responsible for complying with any local laws or regulations governing Reiki practice.

8. User-Submitted Content

By submitting any content (including comments, suggestions, feature ideas, or other material), you grant Whispering Wings Wellbeing a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display, and otherwise exploit such content in connection with the services and our business (including marketing and promotional purposes) in any media format and through any media channel.

You represent and warrant that you have all rights necessary to grant this license and that your content does not infringe or violate the rights of any third party.

You are solely responsible for the content you submit and any consequences arising from its publication. We reserve the right to review, monitor, edit, or remove user-submitted content at our sole discretion for any reason.

9. Prohibited Uses

You agree not to:

• Use the services unlawfully or maliciously
• Upload malware or harmful software
• Attempt unauthorized access to our systems
• Commercially exploit our services without permission

10. Health & Wellness Disclaimer

Content is intended for spiritual support, meditation, and general well-being only.

It is not medical, psychiatric, psychological, or other professional health advice and is not a substitute for care from a licensed professional.

If you have or suspect a medical or mental-health condition, consult a qualified provider.

Do not listen to audio while driving or performing activities requiring attention.

11. External Links

We may link to external websites for your convenience. We do not endorse nor are we responsible for the content or practices of these third-party sites.

12. Disclaimer of Warranties

Our services are provided “as is,” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted or error-free service.

13. Limitation of Liability

To the maximum extent permitted by law, Whispering Wings Wellbeing™, Biofield Transformations, LLC, and their officers, directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, service interruptions, or other intangible losses, arising from or related to your use of the services.

In no event will our total liability for all claims relating to the services exceed the amount you paid us (if any) for access to the services during the twelve (12) months immediately preceding the claim.

You use the services at your own discretion and risk.

14. Dispute Resolution; Arbitration; Class-Action Waiver

You and we agree to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act (FAA) governs interpretation and enforcement. Location: Florida (or remote/virtual by agreement).

Small claims exception: Either party may bring an individual claim in small claims court.

Class/Jury waiver: Disputes are resolved only on an individual basis; class actions and jury trials are waived.

Opt-out: You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms; include your name and the email associated with your account. This section survives termination. Your decision to opt out of arbitration will not affect your other rights or obligations under these Terms.

Mandatory local consumer laws may grant additional rights and certain dispute provisions may not apply.

You agree that any arbitration or court proceeding shall be conducted solely in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

15. Copyright Infringement (DMCA Policy)

If you believe material on the services infringes your copyright, email [email protected] with: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the material and its location (URL) on our services; (d) your contact information; (e) a statement of good-faith belief that use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act for the owner.

We may remove or disable access to allegedly infringing material and may terminate repeat infringers in appropriate circumstances.

16. App Platform Terms (iOS)

For iOS, your license to use the app is also governed by Apple’s Licensed Application End User License Agreement (Apple Media Services Terms). Apple is a third-party beneficiary of these Terms with respect to the iOS app and may enforce these Terms against you. Apple has no obligation to provide maintenance or support for the app, and to the maximum extent permitted by law, Apple has no warranty or liability obligations regarding the app.

In the event of any conflict between these Terms and Apple’s Licensed Application End User License Agreement, Apple’s terms shall control solely with respect to the iOS app.

17. Termination

We may suspend or terminate access to the services or content immediately if you breach these Terms or if required by law. You may stop using the services at any time. Sections that by their nature should survive (including IP, disclaimers, limitations of liability, dispute resolution) survive termination.

18. Force Majeure

We are not liable for failure to perform due to causes beyond our control, including but not limited to natural disasters, pandemics, telecommunications failures, or governmental actions.

19. Compliance with Laws & Export Controls

You agree to use the services only in compliance with all applicable laws and regulations.
You agree not to use the services in violation of U.S. export control laws and regulations, including any restrictions on the transfer of software, technology, or content to certain countries, individuals, or entities.

20. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Disputes shall be resolved in Florida courts, subject to the arbitration clause.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. This avoids an obscure international treaty being applied by default.
